Terms and Conditions
By bidding on any item(s), the bidder shows acceptance of
the terms & conditions of the auction
The Auctioneer assumes no responsibility for the safety or
condition of any item after the fall of the hammer.
Purchases must be paid in full no later than December 15th,
2012 at 3:00 P.M.. Unless other arrangements have been made
in writing.
DESCRIPTIONS / CONDITION - The Auctioneer has put forth
every effort to provide as accurate a description of all
items in preparing this auction catalog. The Auctioneer
shall not be responsible for the correct description,
authenticity, genuineness of, or defect in any lot and makes
no warranty in connection therewith. No allowance will be
made or sale set aside on account of incorrectness, error in
cataloguing or any imperfection not noted. No deduction will
be allowed on damaged articles as all goods being exposed to
public exhibition are sold "as is" "where is" with no
guarantees implied and without recourse. All sales are
final. It is the bidders responsibility to determine the
exact condition of each item. Printed statements of
description are provided in good faith and are matters of
opinion.
BIDDER ? Acknowledges that the auction site is a potentially
hazardous area. Every person at the auction site, during &
after the sale shall be deemed to be at his or her own risk.
Note: All bidders are bound by their signature on the
bidder?s registration. Please read these terms carefully.
ADDITIONS / WITHDRAWALS - The Auctioneer has sole discretion
to reject any and all bids and reject a nominal advance and
reserves the right to withdraw from sale any items listed or
to sell items not listed. The auctioneer reserves the right
to group one or more lots into one or more selling lots or
to subdivide into more selling lots. Wherever the best
interest of the seller will be served, the Auctioneer
reserves the right to sell all of the items listed in bulk
or individually or subject to confirmation of owner. The
trustee reserves the right to accept or reject any of the
bids. All cars sold subject to confirmation. Notice will be
sent within 24 hours of the sale conclusion if the trustee
rejects a bid.
BIDDING - All bidders must provide their name, address,
daytime phone number and e-mail address. This is to insure
good communication between The Hamilton Group and the bidder
throughout their transactions.
PREMIUM / SALES TAX - Internet Buyer's Premium is 15% when
applicable. Sales tax will be charged to the buyer unless
Auctioneer is provided with a copy of their Sales Tax
Exemption form at time of registration
PAYMENT- should be in CASH, VISA & MASTERCARD (COMPANY OR
PERSONAL CHECK WITH A BANK LETTER OF GUARANTEE), or CASHIERS
CHECK, made payable to The Hamilton Group, LLC. The full
purchase price on all lots must be paid for within the time fixed and before the
removal of any
items unless otherwise announced. In default of payment of bills in full within
the time herein
specified, the auctioneer in addition to all other remedies
allowed by law, may retain all monies received as deposit or
otherwise, as liquidated damage. Lots not removed and or
paid for within the time specified herein will be considered
abandoned and may be resold at public or private sale
without further notice, and deficiency together with all
expenses and charges of re-sale, will be charged to the
defaulting purchaser.
DISPUTES - if any dispute arises between two or more
bidders, the Auctioneer may decide the same or may
immediately put the lot up for sale again and resell to the
highest bidder. The Auctioneer shall be the final judge in
all-bidding disputes and shall determine the top bidder. The
decision of the auctioneer shall be final and absolute.
RECORDS - The record of sale kept by the auctioneer and
bookkeeper will be taken as final in the event of any
dispute
LOT COUNTS / Is Just An Estimate And No Allowance For Discrepancies From
Printed Or
Posted Material Will Be Given. Where items are sold by
estimated count, measure or weight, the purchaser will be
billed for and required to pay for the estimated count,
measure or weight. If, any shortage exits, the purchaser
will receive a refund at the rate of purchase. If there is
excess, the purchaser is required to take items and pay for
the excess, at the rate of purchase.
REMOVAL - Shall be at the expense, liability and risk of the
purchaser. No forklift or equipment can be used in the
removal of items unless the rigger shows proper insurance.
Purchases will be delivered only on presentation of paid
bill. Auctioneer shall not be responsible for goods not
removed within the time specified and shall have the option
of removing and storing at the expense and risk of the
purchaser any article purchased but not paid for and removed
within the specified time. CLAIMS - No claims will be
allowed after goods are removed from premises
RESERVES - The Auctioneer reserves the right to reject any
and all bids. On lots upon which there is a reserve, the
Auctioneers shall have the right to bid on behalf of the
seller.
AGENT - The Auctioneer is acting as agent only and is not
responsible for acts of the principals.
